Maternity capital belongs to all Russian families in which a second child is born. But what if a woman is married to a person who does not have Russian citizenship? Will such a family be able to use the mother capital? In most cases, yes.

Mom's citizenship is important

Maternal family capital (MSC) is issued to all women - citizens of Russia who have given birth or adopted a second or subsequent child starting from January 1, 2007. Matkapital can be obtained once in a lifetime. For this reason, a certificate is given for the third or fourth child if the previous children were born before the launch of the social program (that is, before January 1, 2007).

If the mother must have a Russian passport, then the citizenship of the child's father does not matter for obtaining the mother capital. That is, with a husband who is a citizen of another state, this measure of state support can be fully used.

Elena married Anton, whose family recently moved from Central Asia. By the time the two babies were born, the husband still had a Kyrgyz passport. But Elena and her children are Russians, and the family received a mother's capital.

Sometimes a foreign husband himself can get the MSC. But this only happens in situations of unhappiness:

  • if the wife is a citizen of the Russian Federation died;
  • if she is deprived of parental rights;
  • if she has committed a crime against the identity of her child.

The citizenship of the Russian Federation from the father is required only if the man is the only adoptive parent of the child.

A child must also be a Russian

Citizenship of the Russian Federation must be for the baby himself, in connection with the appearance of which he issues capital.

Anya got married in the USA and moved in with her husband with her child from her first marriage. A married couple has their own baby, and he is already an American citizen. Although Anya still retains a Russian passport, she cannot receive maternity capital.

Another case. Tatiana married a Turk and went to live with her husband, she did not change her citizenship. A daughter was born in the family. But Tatiana did not like Turkey, she decided to return. Already in Russia, she had a second child. Since he also received Russian citizenship, the capital is required.

If the citizenship is dual

The presence of dual citizenship of a Russian mother and / or her child does not deprive the right to receive MSC.

Valeria is married to a Latvian citizen. Their children have dual citizenship. Valeria received a certificate for mother capital anyway. It will be possible to use the funds even if Latvia grants a second citizenship to Valeria herself.

The place of birth of the child - it does not matter

The place of birth of the child for obtaining the MSC does not matter. As already noted, it is only important to have Russian citizenship.

Ekaterina works for an international company and is married to a German colleague. Now their place of residence remains Moscow, but Katya flew to Munich to give birth to twins. Kids and mother are citizens of the Russian Federation. Therefore, the MSC is supposed to the family, although the country of birth of the children is Germany.

The family's place of residence is not important

The place of residence of a woman and her children does not affect the possibility of obtaining a mother capital. The main thing remains the same condition - in the column "citizenship" should appear "Russian Federation".

Marine and her children are citizens of Russia. But now their country of residence is Armenia, where the head of the family comes from. But Marine, if he wants, may well get a mother capital.

Spend - only in Russia

An important condition is that maternity capital must be spent in Russia. For example, if a family wants to invest in buying a home, then the house or apartment should not be abroad. The same applies to the opportunity to pay with capital for the child's studies or the purchase of rehabilitation equipment for a disabled child.

Olga married a Belarusian. For several years they lived in Russia, their two children received Russian citizenship. The couple then decides to move to Belarus.

Olga has already received a certificate for maternity capital. But the woman postpones the disposal of his funds in case one of the children wants to study in the Russian Federation.
