Maternity capital belongs to all Russian families in which a second child is born. But what if a woman is married to a person who does not have Russian citizenship? Will such a family be able to use the mother capital? In most cases, yes.

Mom's citizenship is important

Maternal family capital (MSC) is issued to all women - citizens of Russia who have given birth or adopted a second or subsequent child starting from January 1, 2007. Matkapital can be obtained once in a lifetime. For this reason, a certificate is given for the third or fourth child if the previous children were born before the launch of the social program (that is, before January 1, 2007).

If the mother must have a Russian passport, then the citizenship of the child's father does not matter for obtaining the mother capital. That is, with a husband who is a citizen of another state, this measure of state support can be fully used.

Elena married Anton, whose family recently moved from Central Asia. By the time the two babies were born, the husband still had a Kyrgyz passport. But Elena and her children are Russians, and the family received a mother's capital.

Sometimes a foreign husband himself can get the MSC. But this only happens in situations of unhappiness:

  • if the wife is a citizen of the Russian Federation died;

  • if she has committed a crime against the identity of her child.

An important condition is that maternity capital must be spent in Russia. For example, if a family wants to invest in buying a home, then the house or apartment should not be abroad. The same applies to the opportunity to pay with capital for the child's studies or the purchase of rehabilitation equipment for a disabled child.

Olga married a Belarusian. For several years they lived in Russia, their two children received Russian citizenship. The couple then decides to move to Belarus.
