To put the constructed capital construction project into operation, it is necessary to obtain permission to put this object into operation. This permission will allow the facility to be registered with the state. The algorithm for obtaining this permit is regulated by Article 55 of the Urban Planning Code of the Russian Federation.

Step 1

A permit to enter a capital construction facility into operation is a document on the implementation of construction, reconstruction or overhaul of a capital construction facility in accordance with a construction permit, an urban planning plan of a land plot and project documentation. It should be noted that a permit for commissioning (as well as a building permit) is obtained only upon the construction of a capital construction facility, i.e. buildings, structures and structures, but not pavilions, kiosks, etc. The developer obtains such a permit from the federal executive authorities, the authorities of the subjects of the federation or local self-government, which are authorized to issue such permits. The form of permission to commission the facility is established by the Ministry of Regional Development of the Russian Federation.

Step 2

You can get permission to put an object into operation by drawing up an application for such a permit and attaching the following package of documents to it:

1. documents on rights to a land plot (land lease agreement, etc.);

2. permission for the construction of this facility;

3. act of acceptance of the object (required if the construction was carried out on the basis of a contract);

4. documents on the compliance of the facility with technical regulations, project documentation, technical specifications;

5. urban planning plan of the land plot;

6. diagram of the object with the display of networks of engineering and technical support.

In some cases, the conclusion of the state construction supervision authorities may also be required.

Step 3

The authorities issuing permits for the commissioning of facilities have the right to refuse the applicant if:

1. not all required documents have been submitted;

2. the object does not meet the requirements of a building permit, urban planning plan of the land plot, project documentation.

The applicant has the right to challenge the refusal to issue a building permit in court.
