Everyone can face poor-quality services, so you need to know your rights in advance - this will help to return the money spent. If you are poorly served in a cafe or restaurant, this will only lead to a spoiled mood, but mistakes in the field of medicine or tourism can lead to much more serious consequences.
Instructions
Step 1
Ask the staff of the company that provided the low-quality services for the “Book of complaints and suggestions”. Make an appropriate entry in it, indicating the first name, last name, first name and patronymic of the employee serving you.
Step 2
Describe the nature of the incident so that it is clear what exactly is the poor quality of the service provided. Put in the date and time. Remember that you are required to provide a chair, table, and pen on request to write your complaint. If you were denied this, then mark this fact in the book.
Step 3
Call your account manager or business manager. Let us know that you were provided with poor quality services, and you would like to return the money spent. As a rule, if the amount is insignificant, then you can come to a peace agreement and resolve the situation. However, in most cases, you will simply be refused, citing various factors.
Step 4
Write a letter of claim addressed to the head of the company that provided poor quality services. Describe the situation and ask for a refund of the money spent. Refer to the articles of the Civil Code of the Russian Federation that regulate this situation. For example, if you have entered into an agreement for the provision of services and have drawn up an appropriate act, then you must be guided by Part 2 of Article 720 of the Civil Code of the Russian Federation. Send the letter by registered mail.
Step 5
Get a response from the company that provided low-quality services to your letter within ten days from the date of receipt. If you have been denied a refund, file a claim in civil court. In this case, you can demand not only to return the money, but also to pay moral and material damage in the form of penalties. For the trial, you will need all the documents on hand, confirming the fact and amount of damage from the provision of a poor-quality service. Otherwise, it will be difficult for you to prove your case.
