Step 1
Study the trademark requirements that apply to designations to determine the individuality of the products produced. It must be original in origin and have a distinctive character. The image must not be misleading to potential buyers.
Step 2
Determine who will be the owner of the trademark you have developed for your products. This can be, in accordance with the law, a company or an individual entrepreneur, that is, registration of rights to it is carried out only for a legal entity. A licensing agreement should be concluded with the copyright holder, which will be a confirmation of his rights. If within three years the trademark is not used for any reason, then after this period Rospatent may cancel it.
Step 3
Write a list of products that you are going to produce under the developed trademark. It should be compiled using the International Classification of Goods and Services. You need to independently determine the class to which this or that product belongs. If you could not find products in the classifier, then in the future, problems may arise (if you distribute goods by class incorrectly) with Rospatent, which will ask you to make the appropriate adjustments (which requires payment of a state fee).
Step 4
Make an application for registration of a trademark. It must contain an application for registration of the developed designation (do not forget to write the applicant's personal data, his residence address), a list of goods, the trademark itself, its description (type, composition, semantic meaning).
Step 5
After Rospatent notifies about the possibility of registering a trademark, write an application for obtaining a certificate for designation. Attach a receipt or other document confirming the fact of payment of the state fee to the document.
