By law, citizens and legal entities have the right to lease forest plots. To do this, you need to participate in an auction for the sale of the right to conclude a lease agreement for a forest plot and subsequently conclude a lease agreement for such a plot with an authorized body. In some cases, the forest can be rented without an auction.
Instructions
Step 1
Make sure you have to participate in the auction for the lease of the forest plot. According to part 3 of article 74 of the Forest Code, in some cases it can be done without an auction. These are the following cases:
1. For hunting.
2. For geological exploration.
3. For the development of mineral deposits.
4. For the exploitation of water bodies.
5. For the construction of linear objects.
6. For the implementation of priority investment projects.
7. For harvesting wood for the purposes specified in paragraphs 2-5 above.
In this case, contact the authorized state and municipal authority to conclude a lease agreement.
Step 2
In all other cases, you must participate in an auction for the sale of the right to conclude a lease on a forest plot. To do this, you need to submit an application for participation in the auction to the authorized state or municipal body, indicating in it information about yourself (or a legal entity). In addition, you will need to make a deposit and provide a receipt for this. Step 3
The state or municipal body responsible for the auctions prepares the necessary documentation and notifies the public about the auction (usually through the media and the official website of the body). Within a certain period established by this body, other persons are also entitled to submit their applications. Upon completion of their acceptance, an auction is held. If, apart from your applications, there are no, then the authority is obliged to conclude a lease agreement for the forest plot with you.
Step 4
A lease agreement for a forest plot is concluded with the winner of the auction within 10 working days from the date of signing the minutes of the auction. It is prepared by the authorized body in the form approved by the Government of the Russian Federation. The same authority calculates the rent for the plot and reflects it in the contract. Its minimum size is determined as the product of the rate of payment per unit area of the site and its area. The rates are set by the government.
