Step 1
Find out the requirements for living space and family members, whose presence is necessary for the implementation of the section of the personal account. A separate account can be issued to a citizen of the Russian Federation who has reached the age of majority, is legally capable and is registered in this apartment. At the same time, he must permanently reside in it and be a family member or former relative of the employer. Also, the apartment should have an isolated room for which a personal account is issued. The fact is that a change in the lease agreement implies the transformation of an apartment into a communal apartment, and family members into neighbors.
Step 2
Gather all the necessary documents that will allow you to make a section of the personal account. There must be a plan of an apartment from the BTI, which indicates the total area and area of each room. This will allow housing authorities to determine the size of the proportion of new personal accounts.
Step 3
Also attach a copy of the current financial and personal account, an extract from the home book and a certificate of income of the person for whom a separate personal account is being drawn up. If former spouses live in the same living space, then a divorce certificate will be required.
Step 4
Get the written consent of all family members living in this apartment to split the personal account in shares. This will allow you to solve the problem in a relatively peaceful way. The collected package of documents is submitted to the Office of the Department of Housing Policy and the Housing Fund of the Russian Federation, where an application for amending the lease is filled in according to the sample. If it was not possible to obtain consent, then the dispute is resolved in court.
Step 5
Submit a claim to the court, which is located at the location of the branch of the UDZHPiZhF RF, which acts as a defendant in the case. Pay the state fee. After the satisfaction of your claim, you will receive a court decision, on the basis of which separate personal accounts will be formed in shares corresponding to the occupied living space.
