Placing government orders and holding auctions for the right to participate are regulated by Federal Law No. 94-FZ "On Placing Orders for the Supply of Goods, Performing Works, Rendering Services for State and Municipal Needs". Compliance with the law is monitored by the Federal Antimonopoly Service. Placing an order is carried out as an auction, which has been held on electronic platforms since 2011. Non-compliance of a quotation order with the established requirements may result in its rejection.
Instructions
Step 1
The basis on which the conformity of quotation bids is checked is a notification of the request for quotations. The customer has the right to reject the application if it does not meet these requirements. In addition, the reason for the rejection may be the cost of services and the price of the goods, which will exceed the maximum value specified in the notice of the request for quotations.
Step 2
According to the letter of the Ministry of Economic Development of the Russian Federation and the Federal Antimonopoly Service of the Russian Federation dated August 19, 2009 No. 13613-AP / D05, the commission may reject the application for the auction in the event that the customer has indicated in the application all the necessary details for the transfer of funds supporting the application, and the participant did not attach to the package of documents submitted for participation in the auction, a payment order confirming the transfer.
Step 3
The application can be rejected even if the payment order or its copy is attached, but the details of the participating company specified in them do not correspond to those indicated in the documentation. When the amount of payment is less than that which was specified in the application, the participant is also withdrawn and deprived of the right to participate in the auction.
Step 4
When the requirement to indicate the supplier's trademark is established in the auction documentation in electronic form, then even if the customer does not present this requirement, the application may be rejected. This follows from Article 41.8, part 4 of the Public Procurement Law.
Step 5
Another reason for the rejection of the bid for the auction will be a violation of the Federal Law "On Electronic Digital Signature". A quotation application filed in the form of an electronic document is signed with an electronic digital signature (EDS) of an authorized person. If there is no EDS, the application will not be considered legitimate, and you have the right to reject it, because without this the customer cannot recognize the equivalence of the EDS and the applicant's signature made with his own hand, in accordance with Art. 4 of the specified law.
Step 6
An application for an electronic auction may be rejected if there is a shortage of funds on the participant's personal account. Their amount must be no less than the established amount of the application security.
