A receipt is a document that equates to a loan agreement. A capable citizen who has undertaken debt obligations must timely repay the entire amount with the interest indicated in the receipt (Article Nos. 18, 19 of the Civil Code of the Russian Federation).
It is necessary
- - application to the court;
- - passport and photocopy;
- - IOU and photocopy;
- - written notification of the debtor;
- - a receipt for the return of the debt.
Instructions
Step 1
If you issued borrowed funds, issued a receipt indicating all the conditions of the loan, the terms of repayment, but at the same time you did not return the debt on time, contact your borrower in writing with a request to repay the debt in full. To do this, use the services of the Russian post office, send a letter with a notification and a list of investments in order to have documentary evidence that you have notified the debtor and reminded him of the deadlines for fulfilling debt obligations.
Step 2
Most often, the notification is enough to return the debt, since the debtor could simply forget about fulfilling the obligations assumed. If, after receiving the letter, they still do not plan to return the debt, apply to the arbitration court with a statement of claim.
Step 3
Attach the original and a photocopy of the passport, the original and a photocopy of the debt receipt to the application. On the basis of a court order, you will be able to collect the entire amount forcibly at the debtor's place of work, from bank accounts or by filing claims against the existing property. In addition, your debtor may be forced into forced labor until the entire amount of the debt is paid off.
Step 4
To repay the debt on a receipt on a voluntary basis, the debtor must contact the creditor, invite two witnesses, in whose presence they draw up a new written document on A4 paper that the debt was repaid in full and on time. Put the signatures of the debtor, creditor and witnesses under the document, indicate passport data.
