There are homeowners who directly refuse to pay for overhaul, because they do not understand where this money is going. And there are those who, for some reason, do not know whether they have this debt. Penalties for debt in any case will be the same. But how do you know if there is a debt before they happen?
Payment for major repairs is considered by law to be the responsibility of each tenant-owner in an apartment building. And if a person refuses to pay and systematically misses payments, then the management company has the right to sue him. True, only after three months of missing payments.
The court decides whether the tenant really has a debt, and if so, what measures should be taken in this case. And by the way, according to statistics, the majority of such claims are satisfied by the court in favor of management companies.
And when the judgment is rendered, the bailiffs will come to the defaulting owner to collect the entire amount of the debt from him. If he is not at home (or the debtor does not open the door), the bailiffs will leave a written notice. And they will come until the debt is paid.
However, if 2 months pass from the day of the first visit of the bailiffs, and the owner still does not pay for the major repairs, the bailiffs will have the right to take the property from him in compulsory payment of the debt.
In addition, the state is tightening its control over non-payment of capital repairs in every possible way. For example, debtors who live in apartments on the condition of social rent may well be deprived of housing. Non-payers are threatened to turn off hot water, as well as electricity, they can cut off the sewer, although this is just a debt for capital repairs.
As you can see, this is a serious matter, and you cannot afford to be in arrears. But how do you know if the owner has a debt? There are three ways to do this:
- The owner can go directly to the finance department of the management company or the capital repair fund that serves the house and inquire about the debt. The phone number of the management company can be read on the rent receipt.
- In addition, the owner can visit the site of the management company: a variety of services are provided there, including the opportunity to get acquainted with detailed information on payments and debts made.
- The owner should take a closer look at the rent receipt: if he has a debt, it will be reflected in it. In addition, the Criminal Code, along with such a receipt, may send an additional invoice, which will indicate the amount owed.
By the way, not all categories of residents are obliged to pay for major repairs. Tenants do not have to do this because landlords must pay for them. But the requirement of payments for overhaul from employers is illegal. There are also categories of tenants who have benefits. The law refers to them:
- WWII veterans and labor veterans;
- residents over 70 years of age;
- Widows of the participants Vov;
- liquidators of the accident at the Chernobyl nuclear power plant and those who suffered from radiation;
- large families or parents of disabled children.
All other owners are required to pay for major repairs on time, otherwise unpleasant consequences in the form of a court and court sanctions will be inevitable.
