None of the debtors likes collectors, whose functions include the return of overdue debts. Even if the representatives of the collection agency act strictly within the framework of the law, communication with them does not bode well. But what if the collectors violate professional ethics by forcing the debtor to return the amount? Is it possible to effectively deal with them?
Instructions
Step 1
When talking by phone or direct communication with a representative of a collection agency, ask him to introduce himself. Let him give his last name, first name, patronymic and position held. Also ask for the name of the agency that the collector represents and provide contact details. By giving you this information, the collector will be forced to behave more restrained and ethical.
Step 2
Call the specified phone number to the collection agency to check the information provided to you. Also contact the bank with which you are associated with the loan obligations, and find out whether the right to return the debt has actually been transferred to this collection organization.
Step 3
Ask the collectors to provide you with documents that establish that this structure operates on the basis of an agency agreement and legally represents the interests of a bank or other credit institution.
Step 4
Remain calm and self-possessed when dealing with collectors. If the conversation turns into a raised tone, and representatives of the agency begin to use threats, remind them that such a tone is inappropriate in this case, and the threats violate your legal rights.
Step 5
When answering the collectors' questions, do not take the position of a petitioner, do not immediately try to persuade the agency representatives to soften the conditions. Provide only dry facts, without giving detailed and confidential information that can later be used against you.
Step 6
If it is technically possible, record a telephone conversation with collectors or use a voice recorder in personal contact. Such actions on your part are not prohibited by law and can moderate the ardor of overzealous debt collectors. The recording of the conversation can also become one of the evidence of illegal actions if you decide to go to court.
Step 7
After the first visit to the collectors, immediately seek the help of a qualified lawyer. A legal professional will be able to give a correct assessment of the actions of the collection agency and suggest the most reasonable tactics of behavior in your specific conflict situation.
