Step 1

In order to rent a store, you need to understand how the business will be organized. Will it be a legal entity registered in accordance with the procedure established by law, or commercial activities will be carried out by an individual entrepreneur. To rent a retail space, it is necessary to request from the owner of the non-residential premises the title and legal documents. These include: a contract of sale, donation, equity participation in construction, documents on privatization or inheritance, a certificate of ownership, as well as a cadastral and technical passport, an extract from the register of rights to real estate.

Step 2

The tenant and landlord can be both individuals and legal entities. To conclude a contract, an individual must have a passport. If the party to the agreement is a legal entity, then the package of documents for concluding a lease agreement is significantly increased. The organization must provide: the charter, amendments to it, certificates of state registration of a legal entity and registration with the tax authority; information letter from the statistical office with economic activities; extract from the unified state register of legal entities; protocol of appointment of the head of the organization.

Step 3

After the lease is concluded, the tenant must receive documents from the supervisory authorities: the conclusion of the State Fire Supervision Service (on the fire safety of the premises); conclusion of Rospotrebnadzor (on the sanitary and epidemiological state of the premises). You also need to buy and register a cash register; obtain a license in cases stipulated by the legislation of the Russian Federation; obtain permission to place advertisements in the district or city administration and produce a passport for the advertising space.

Step 4

A lease agreement for non-residential premises is concluded only in writing, if the term of the agreement exceeds one year, then it is subject to state registration with Rosreestr. If the premises are subleased, then it is mandatory to obtain the owner's consent to transfer the premises to sublease, unless otherwise provided by law or contract. It is necessary to check with the owner of the facility whether there are contracts concluded with organizations that supply utilities.
