The seizure of the current account or the suspension of a number of transactions on the accounts is applied in the event of late payment of tax, fines or penalties, as well as as a result of failure to submit a tax return within 10 days from the expiration of the established period. The seizure rules are governed by Article 76 of the Tax Code of the Russian Federation.
Instructions
Step 1
Find out the reason for the seizure of the current account. This information can be found by reading the decision to suspend the taxpayer's account transactions. If this decision is not received by you or did not arrive by mail, then contact the bank or the inspection of the Federal Tax Service of the Russian Federation to receive a copy. Upon receipt of a decision to suspend transactions on settlement accounts from the bank by power of attorney, the unblocking period can be reduced by 3-4 days.
Step 2
Eliminate all indicated violations. Prepare and file tax returns. Pay the accrued taxes, penalties and interest. Submit supporting documents to the tax authority upon elimination of violations. Erroneous seizure sometimes occurs.
Step 3
In order to quickly unblock the account, draw up an updated declaration and present it to the tax office, having paid the accrued fine. You can also defend your case by contacting a higher tax authority or in court. This procedure will take at least 2 weeks. It is worth noting that in the event of an erroneous arrest, you will not be compensated, even if serious losses are incurred or a business proposal is missed, so sometimes a faster and more profitable option is to admit that you are “wrong”.
Step 4
Receive the decision of the tax service to remove the arrest from the current account, which is issued no later than one day after the elimination of violations.
Step 5
Provide the bank with a decision to cancel the suspension of transactions on current accounts. The bank will release the seizure and resume operations.
