Types and procedure for granting a survivor's pension

There is a special procedure for assigning and calculating pension payments in the event of the loss of a breadwinner, therefore, after the death of a relative, the rest of the family should familiarize themselves with the current version of Federal Law No. 400, which specifies the specifics of receiving assistance from the state. In particular, there are three types of survivor's pension: social, state and insurance (labor).

The social pension for the loss of the breadwinner is the main subsidy on which the following categories of citizens can count:

  • minors and incapacitated children to whom the deceased was a parent, grandfather / grandmother or brother / sister (his next of kin);
  • the closest relatives of the deceased under the age of 23, studying full-time at a university or secondary specialized educational institution;
  • close relatives of the deceased who have reached retirement age.
  • close relatives with a degree of disability;
  • relatives of the deceased who are disabled and have lost income due to the death of the breadwinner.

The state pension for the loss of a breadwinner is awarded if the deceased was a serviceman or took part in the elimination of accidents of a man-made or radiation nature (for example, the accident at the Chernobyl nuclear power plant). As for the insurance pension, it is assigned only if the deceased was previously registered with the OPS of the Russian Federation (there is a corresponding certificate with a personal number) and was officially employed for at least one day.

How to apply for a survivor's pension

In order for the required subsidies to be paid to the relatives of the deceased, they must necessarily submit an appropriate application to the local branch of the Pension Fund. It will be necessary to provide a list of certain documents, which include copies of the passport and SNILS of the deceased and persons applying for a pension. You will also need a death certificate (breadwinner) or recognition of a citizen as missing by a court decision. To confirm the labor status of the deceased, you will need a military ID, copies of employment contracts, extracts from personal accounts, certificates from the place of work and other available documents.

After considering all submitted papers, the Pension Fund makes a decision on what types of pension and what relatives of the deceased or missing person are entitled to, and also establishes their size. This decision is undeniable and immediately enters into force. The money must be transferred starting from the month following the decision.

How to complain about the Pension Fund

If the Pension Fund, without explaining the reasons, stopped transferring any required types of survivor's pension, it is necessary to file a complaint against the head of the Pension Fund of the Russian Federation. The application must be reviewed within 30 days. If this was not followed by an answer, or the decision of the organization's management did not suit you, you should contact the prosecutor's office or court.

It would be most correct in the future to apply to the prosecutor's office, drawing up a new complaint against the PFR Department and indicating in it in as much detail as possible what violations the organization committed. Based on the appeal received, the prosecutor's office will have to check. If violations are detected, it is the supervisory authority that will take on the responsibility to eliminate them. Finally, you can go to a magistrate or arbitration court, filing a claim for violations. If the Pension Fund really performed illegal actions in relation to one or several citizens, it will be obliged to compensate the losses incurred by them.
