Residents of apartment buildings are not always aware of the responsibilities of house management companies. For this reason, companies may sometimes fail to fulfill their responsibilities to the fullest.
Contract
According to the legislation of the Russian Federation, the obligations of the management company must be reflected in the management agreement for an apartment building. This contract must be drawn up in writing and signed by the managing organization and the owners of the apartments in the building. One of the copies must be kept by the management company, and the other by the owner of the premises, but this condition is not always met. If the owner of the home does not have a copy, he has the right to send a written request to the house management company in order to receive the contract and attachments.
As stated in part 2 of Article 162 of the Housing Code of the Russian Federation, the management organization must, within the period specified in the contract, perform work and provide services for the maintenance, operation and repair of the common property of the house, the provision of utilities to the owners and other necessary activities. The terms of the contract are approved by all tenants during the general meeting, when they choose the method of management and the managing organization.
The contract must indicate:
- the address of the apartment building and the composition of its common property;
- list of utilities;
- a list of works and services for the repair and maintenance of common property, the procedure for changing this list;
- the procedure for determining the amount of payment for the repair and maintenance of premises and for utilities, as well as the procedure for making payments;
- the procedure for exercising control over the fulfillment of its obligations by the management company;
- the term of the agreement (not less than a year and not more than five years).
Main responsibilities
Here is just a partial list of services that the management company is obliged to provide and which must be spelled out in the contract:
- to ensure the proper maintenance of the common property of the house in accordance with the list of services and works specified in the contract;
- to ensure the supply of water, drainage through intra-house networks, the supply of energy resources (electricity, gas heating);
- control the quality and quantity of supplied resources;
- organize maintenance work, preparing the house and the yard for seasonal operation on its own or with the involvement of third-party contractors: cleaning and sanitary maintenance, garbage disposal, maintenance of fire systems, ventilation and elevators, maintenance of landscaping and landscaping;
- to carry out acceptance of works performed by contractors, to check their quality;
- organize major and current repairs;
- carry out technical inspections, maintain technical documentation for buildings and structures, communications, for other objects;
- when allocating budget funds to the management company, monitor their rational and targeted use;
- calculate and take into account payments for housing and communal services;
- to carry out dispatching services at home for the timely elimination of emergencies;
- control the processes of reorganization of premises in the house in order to prevent damage;
- communicate with the population regarding compliance with electrical safety rules, fire safety and the use of engineering equipment systems;
- consider complaints from residents and respond to them, eliminating service deficiencies.
