Some companies conscientiously fulfill their responsibilities for the improvement of the entrusted and property, while others do not want to do absolutely anything. Even taking into account the amendments to the housing code, getting rid of a negligent management company (MC) is not so easy.

Step 1

The owners can unilaterally terminate the agreement with the management company. To do this, you need to collect a general meeting of residents of an apartment building. Amendments have been made to Articles 161 and 162 of the Housing Code of the Russian Federation. Taking them into account, you can write a collective complaint. But the contract can be terminated only after a year from the date of the contract with the Criminal Code. If the contract was concluded on September 1, then no earlier than September 1 of each subsequent year it can be terminated (part 8.1 of article 162 of the Housing Code of the Russian Federation). If the Criminal Code does not fulfill its obligations, the contract is terminated under clause 8.2 of Article 162 of the Housing Code of the Russian Federation.

Step 2

When a collective complaint is signed by all residents of the house, you need to go to the prosecutor's office and write a statement that the actions of the Criminal Code are illegal, that it does not fulfill the obligations imposed on them. Be sure to provide the prosecutor with the minutes of the meeting of residents, at which they unanimously decided to get rid of the Criminal Code.

Then the court awaits you. here you must collect all the evidence: photographs of hanging icicles that are about to collapse, an uncleaned house area, a leaking roof. But keep in mind that when the contract was concluded with the management company, the work that would be carried out during the year was discussed. If roof repair was not included in the list of these works, then a leaking roof is not a violation of the current contract. In court, there is a high probability that the tenants of the house will win the case and get rid of the housing code that did not comply with the terms of the contract. If the management company caused damage to the residents of the house, it will have to be paid.
