However, homeowners can refuse the services of an unscrupulous company at any time.

Step 1

The owners of residential premises in an apartment building have the right to choose a way to manage the house. This could be:

- management directly by the owners;

- management of the HOA or housing cooperative;

- management of the management company.

Step 2

The choice of the management method is determined at the general meeting of the owners of residential premises, after which a protocol is drawn up. In favor of one method or another, at least 50% of the votes must be cast.

Step 3

If a management company is chosen as the method of management by a majority of votes, then an agreement is concluded with it for a period of not more than 3 years. The management company can also be selected as a result of an open competition announced by the city administration.

Step 4

At the end of each year, as well as at the end of the contract, the general meeting of owners can initiate a cancellation of services unilaterally. For such a decision, more than 50% of the votes will also be needed.

Step 5

In addition, homeowners have the right to terminate a previously concluded agreement without waiting for the end of the year. To do this, it is necessary to make such a decision by a majority of votes at the general meeting and submit a collective application to the court to terminate the contract, due to non-compliance by the management company with its conditions. According to the latest legislative acts, documents proving the fulfillment of the contract must now be submitted to the court not by the tenants, but by the management company. If the court makes a positive decision on this issue, then the contract is terminated.

If homeowners, for one reason or another, cannot attend the general meeting, they can be sent notifications of the meeting agenda and forms for absentee voting, which can later be attached to the minutes.
