The Civil Code provides for the conclusion of an agreement both orally and in writing. The written form of the contract is obligatory if one of the parties to the contract is a legal entity. But even if the parties are individuals, it is better to insure yourself and draw up any contractual relationship in writing. In order to draw up a contract, several recommendations should be taken into account.

Step 1
The contract can be typed or handwritten. Make sure the text is clear and legible. Do not use language that can be interpreted in two ways. The essence of the contract should be stated clearly and understandably.
Step 2
When naming the parties to the contract, indicate more data so that you can clearly define between whom the contract is concluded. In addition to the surname, first name and patronymic, indicate passport data, date of birth, TIN, address. Attach copies of passports to the contract.
Step 3
Make sure that the text reflects all the essential terms of the contract. If you find it difficult to define them yourself, refer to reference books or relevant laws. Essential conditions include those without which the agreement of the parties is impossible. Different types of transactions have their own conditions, but, as a rule, the subject of the contract, terms, price are obligatory among them.
Step 4
The more complete the text of the agreement, the less disagreements the parties may have in the future. Provide in advance and write down in the contract penalties for improper performance of obligations under the contract, determine the procedure for action in force majeure circumstances, choose a court to contact if it is impossible to resolve any issues through negotiations.
Step 5
Indicate the special conditions that are important for the proper performance by the parties of their obligations under the contract. The provisions of the agreement may be individual, not provided for by law, but they should not contradict it or the customs of business.
Step 6
To draw up a contract, you can use ready-made forms by entering the conditions necessary for a particular transaction. You can also contact a notary office. Having found out all the essential conditions for your transaction, the notary staff will draw up an agreement themselves, you just have to check it and pay for the service.
