When performing a large number of payment transactions, errors occur for various reasons. Step 1

Check with your bank whether your payment order has been accepted or not. If the money has not yet been transferred to the account of the “wrong” counterparty, send a letter to the bank with a request to revoke the payment order. The money will remain in your checking account.

Step 2

Draw up and send a letter to the counterparty with a request to return the funds if the bank has already transferred money from your current account to the counterparty's account using this payment document. Specify the details of your organization in the letter. Attach a copy of the payment order.

The counterparty is obliged to return the money within 5 working days. If he refuses to return the unlawfully received funds, you will have to sue him.

Step 3

Compose and send a letter directly to the bank with a request to return the erroneously transferred money, if everything is correct in your payment document, and the amount was transferred to another counterparty as a result of an error of a bank employee.

Having received your letter, the bank will notify the recipient of the amount mistakenly transferred to his account. After receiving the notification, the counterparty is obliged to transfer this amount to your current account within 3 working days.

Step 4

Notify your employee in writing if you mistakenly transferred funds to his bank card by overpaying wages. Obtain written consent from your employee to make the overpayment to the cashier and accept cash from him on the incoming cash order, or issue an order to deduct the excess payment from his wages.

Step 5

Submit a statement about the mistake made to the tax authority at the place of registration, if you find an error when transferring funds to pay taxes to the budgets of the Russian Federation. Attach a copy of the payment document confirming the payment of tax to the application. The tax authority may conduct a joint reconciliation of taxes paid.

The excessively transferred amount will either be credited to you against forthcoming payments for this tax, or returned within a month from the date of receipt of the application by the tax authority. Keep in mind that if your organization has arrears, interest and penalties for this tax, they will be deducted from this amount upon refund.
