According to the Labor Code, all employees working under an employment contract are entitled to annual leave with pay. Its duration is 28 calendar days, but the number can be increased for some categories of workers, for example, those who work in hazardous working conditions. In case of dismissal, the employer must pay compensation for all days of unused vacation. How is this size calculated?

Step 1

First, determine the number of unused vacation days. To do this, calculate the length of service. This includes the days when you were at work, as well as days when you were absent, but you kept your wages, for example, on sick leave, and count the period of forced absenteeism, for example, when unlawfully suspended from work.

Step 2

It is known that an employee is entitled to at least 28 calendar days per year. Thus, calculate the required number of vacation days per month: 28/12 = 2, 33 days. In the event that you are entitled to additional leave, for example, 8 days, then the calculation will be as follows: 36/12 = 3 days for each month.

Step 3

When calculating, you may have a so-called "tail", that is, the number of days that do not make up a month. If their number is less than 15, they are discarded, and if there are more, they are counted as a whole month. For example, engineer Ivanov worked from March 01, 2010 to July 23, 2010. Thus, the calculation of unused vacation days will be calculated as follows: 28/12 * 5 = 10.4 days of the prescribed vacation.

Step 4

Then calculate the average earnings. To do this, add up all types of payments to this employee for the period for which compensation is calculated. This includes salaries, bonuses, and supplements. For example, the same engineer Ivanov from March to May received 24,000 rubles, in June he was on sick leave and the payment on the ballot was 7,000 rubles, and in July he received 10,000 rubles. Thus, 24,000 rubles + 7,000 rubles + 10,000 rubles = 41,000 rubles for the entire period of work.

Step 5

After that, divide the amount received by the number of months worked and by the average monthly number of days - 29, 4. It turns out 41,000 rubles / 5 months / 29, 4 = 278, 9 rubles.

Step 6

Then multiply the resulting number by the number of days for which compensation is due. The resulting number will be compensation for unused vacation.
