Many insurance companies sin by refusing to pay insurance compensation to their clients, understating amounts and violating deadlines. They argue these actions in every possible way, confusing Russian citizens who are little familiar with legal legislation. Step 1
File a written claim with the insurance company. Indicate in it the reasons for your disagreement with the decision of the insurers, and also state your requirements, which should not go beyond the law and be reasoned. Indicate in the claim the fact of non-fulfillment of obligations and the timing of compensation payments.
Step 2
Send this application by registered mail with a list of attachments, you can also use a courier service for a greater guarantee. Save your receipts so that you can confirm the shipment.
Step 3
Write a complaint to the Federal Insurance Supervision Service (FSIS) if the complaint did not help solve the problem. Indicate the norms of the law that the insurers violated, and attach to the application certified copies of all documents you have on this issue. The FSIS will consider the situation and make a request to the insurance company to obtain documents on your case. Your complaint will be reviewed within 30 days, after which a written response will be sent to you. As a rule, during this time, insurance companies contact the client and try to peacefully resolve the conflict.
Step 4
File a lawsuit. Litigation is a time-consuming, time-consuming and financially costly process, so it should only be resorted to if the previous steps have failed. First, estimate your costs of the court and the possible receipt of insurance compensation from the accrued interest.
Step 5
Submit the following package of documents to the court: statement of claim in triplicate; a copy of the insurance claim application; copy of the certificate and the damage incurred; a copy of the documents confirming the ownership of the property for which the insurance compensation takes place; a receipt for payment of the state fee, as well as other documents that are involved in the case.
Step 6
See an experienced policyholder advocate. If the court accepts your side, the insurance company will be obliged to pay you the amount of compensation and a penalty for each day of delay in the amount of 1/75 of the refinancing rate of the Central Bank of the Russian Federation.
