Most payments between legal entities are made in a non-cash form, that is, funds are debited from the payer's current account and credited to the beneficiary's current account. Sometimes there are unpleasant cases when money comes to another recipient, and not to the one to whom it was actually intended. This can happen due to incorrectly specified details, an error of the bank operator, or for some other reason.
Instructions
Step 1
For example, a mistake was made in the payment order - another current account of the beneficiary was indicated. It actually exists, belongs to a very specific legal entity, only your payment was not intended for him. This sometimes happens when the accounting department is very busy. How to be in a similar situation?
Step 2
Send an official letter to the name of the head of this organization or the chief accountant. Briefly explain the situation and ask to return the mistakenly transferred amount to your current account. The letter must be signed by the head of the paying organization and certified by his seal. It must be accompanied by a photocopy of the payment order by which the bank transferred the funds.
Step 3
In most cases, the money is returned fairly quickly. If, for some reason, the management of the company, where they were mistakenly transferred, delays the return, you should be warned that you will go to court with a claim, demanding also payment of interest for the use of other people's funds. As a rule, after that the issue is resolved without delay.
Step 4
The following may also happen: as a result of an error in the payment order, a current account is indicated that does not exist at all (for example, the order of the numbers was mixed up). In this case, the head or chief accountant of the enterprise must contact the bank with a written application to revoke this payment order. Since a certain percentage (commission) is charged for each banking transaction, an internal audit will be carried out to determine whose fault was made. If it turns out that an error in the payment order was made by an accounting officer of the paying organization, the commission will remain with the bank, and if the bank operator made a mistake, the commission will be returned to the payer.
