It is necessary

  • - a court decision on the recovery of alimony;
  • - Decree of the Government of the Russian Federation No. 841 of July 18, 1996 "On the list of types of wages and other income, from which alimony for minor children is withheld."

Instructions

Step 1

If you are filing an application for the recovery of alimony and do not know how to independently determine the amount of alimony (if the spouse does not have official income), then you can consult a lawyer. He will provide clarifications and help to draw up the application correctly.

Step 2

If you are an accountant of a company and you have a need to calculate alimony, then it is worth considering the following. In accordance with article 109 of the Family Code, the employer is obliged to transfer alimony from the income of persons who are obliged to pay it. The writ of execution must be correctly drawn up and contain all the required details. If a specific amount of alimony is indicated in the writ of execution, then nothing additional is required to calculate. The employer transfers alimony once a month no later than three days from the date of payment of wages to the employee. These amounts can be issued through the cashier, transferred to a bank account, or sent by mail. The costs of transferring funds are paid by the employee from whom they are withheld. These amounts are not deducted from the advance.

Step 3

If the amount of alimony is not fixed, then its amount is 25% of earnings for one child, 33% for two children and 50% of income for three or more children. It should be noted that alimony is deducted from income after the deduction of personal income tax. Please note that there is a list of income from which child support needs to be withheld. There are also exceptions in it, i.e. income that should not be included in the base for calculating the amount of alimony (for example, severance pay upon dismissal, material assistance in case of natural disasters, the birth of a child).

Step 4

Withholding of alimony is also made from non-working citizens. They are calculated and accrued based on the subsistence level of a particular region. The percentage of the subsistence minimum is determined in court.
