In accordance with the Family Code of the Russian Federation, parents are obliged to support their minor children until they come of age, since minor citizens are disabled. The amount of pay can be determined on a voluntary basis by writing an agreement certified by a notary. If it was not possible to conclude a voluntary agreement, then the amount of the alimony is determined by the court. This amount can be reduced by concluding a notarized voluntary agreement on the payment of a different amount of funds for the maintenance of the child or in court.

Instructions

Step 1

According to the law, for the maintenance of one child, 25% of the total income of the payer is paid, for two children - 33%, for three or more - 50%. If there is a debt on the payment of alimony, then 70% of all income can be deducted from the debtor until the debt is fully repaid.

Step 2

If you have any difficulties, and you want to reduce the amount of alimony, but you cannot do it peacefully, then file a statement of claim with the court with an evidence base, on the basis of which you want to pay a lower amount for child support. The amount of the alimony can be reduced after the decision is made by the court.

Step 3

Alimony can be reduced if you have another child or children, since all children of one parent have the right to equal maintenance. If you pay 25% of income for one child, and you have another child in another family, then the percentage of alimony per child will be reduced to 16.5%, since maintenance for two children is 33% of all income. If you have two children, the percentage of payments will be reduced in accordance with the equal maintenance of children based on 50% of the income.

Step 4

If you are a disabled person in need of outside care, the amount of child support may be reduced by a court decision.

Step 5

Also, the amount of alimony can be reduced if the child is 16 years old, he has acquired legal capacity or receives significant income from business or existing property.

Step 6

The amount of child support can be reduced if your income is too high, and the amount of payments exceeds all reasonable limits. But usually people with huge incomes do not sue for a reduction in the amount of support per child.

Step 7

By a court decision, the amount of alimony can be reduced if disabled family members are in your support.
