They have every right to study all documents related to the operation of the house. The owners have the right to terminate the contract if it expires. In addition, having carefully studied the contract concluded with the management company, you can initiate its termination if any of its clauses are not fulfilled. The grounds for termination of the contract are also: failure to provide the requested information within five days, poor-quality provision of services or their provision not in full, failure to provide services.

Step 3

The relevant requirements must be made in writing in duplicate. Transfer one of the copies to the office of the management company (the second copy must be marked with registration), or send it by registered mail with a notification, while it is necessary to make an inventory of the attachment.

It is necessary to request the relevant documents: an act on the performance of work for the last two years, an act on the inspection of engineering networks, also for two years and a service contract.

Before choosing a new managing organization, it is necessary to determine the list of works and services that will be provided. After that, you need to find out as much as possible about the chosen organization, talk to the residents of the houses who have entered into an agreement with it, check the availability of accreditation with the authorities, discuss the basic agreement at a meeting of homeowners.

With the help of a lawyer, it is necessary to draw up the text of the agreement with the new organization. The contract must include:

• A list of services and works aimed at maintaining common property, as well as the procedure for changing it.

• The composition of the common property that is transferred to management.

• The procedure for exercising control over the work of the management company.

• The procedure for determining the cost of work performed and services provided (these prices are set by homeowners).

After that, at the next meeting of owners, the contract with the old company is terminated and signed with the new one.

The management company, with which the contract is terminated, must be informed about the non-extension of the contract 30 days before the end of its term, and the bank must be informed about the change of the management company (about the termination of settlements with the old organization) and the organization that calculates the payments.
