When buying a travel package, customers are full of good expectations. They are already looking forward to swimming in the warm sea, trips to attractions, pleasure from delicious exotic local cuisine. Alas, sometimes it happens that after paying the money, potential tourists cannot get tickets, vouchers, or health insurance. Because the travel agency suddenly had problems, including bankruptcy. It is even worse if these problems began when the tourists had already managed to fly to their destination.
Alas, no one is insured against bankruptcy. Even a large, reputable travel agency that has been successfully operating in the tourist services market for many years can find itself in a difficult situation. What should its clients do in such a situation, how can they get their money back?
Option number 1. You found out even before you left that the travel agency from which you bought the ticket was on the verge of bankruptcy. The source of information is not important in this case. It is best to do this: take a letter addressed to its management to the office of the travel agency, which will ask whether this organization confirms its readiness to fulfill its obligations to you under such and such an agreement from such and such a date. The letter must be in duplicate. Make sure that on the second copy (which will remain with you) a note is made: such and such a number was accepted, by whom, with the signature of this employee. If you live in another city, send the same request by fax.
According to the current legislation, the answer must be given to you no later than 7 days from the date of acceptance of the letter. If you have not received this answer, feel free to contact the financial guarantor of your travel agency (bank or insurance company) with the requirement to return you the cost of the voucher. Refer to the fact that a response not received on time is tantamount to a refusal of the travel agency to fulfill its obligations under the agreement concluded with you.
Option number 2. You learned about the bankruptcy of your travel agency after arriving at your destination, when you were faced with the fact that the booked hotel room was not paid for. Unfortunately, most likely you will then have to pay the cost of accommodation, as well as additional services (for example, excursions, meals) provided for by the contract. And after returning to Russia to collect these unforeseen expenses from the financial guarantor of the travel agency. To do this, save all documents confirming the expenses you made, for example, checks, receipts. Be sure to try to get a certificate from the owners of your hotel that the cost of your stay was not paid by the travel agency. Tune in in advance that if the guarantor of the travel agency does not meet you halfway, you will have to go to court.
