In the course of its activities, the company may face a situation where the counterparty refuses to pay for the services rendered, work performed or goods delivered. In this case, in order to repay debts, it is necessary to make sure that supporting documents are available and perform a number of mandatory procedures.
Instructions
Step 1
Conduct an analysis of the accounts receivable of this organization to your business. Make a calculation table for services rendered or goods sold. As a result, you should get the exact amount of debt. Draw up a statement of reconciliation of calculations for the entire period of cooperation. This document is drawn up in any form in two copies. Pass both options to the counterparty with a request to confirm the debt and put your signature on the deed. Support the received document to the agreement.
Step 2
Write a claim letter. Indicate in it the amount of the resulting debt, the timing of the debt repayment and possible measures in case the counterparty fails to fulfill its payment obligations.
Step 3
Be sure to mark the amount of the fine, which must comply with the terms of the agreement or the provisions of the Civil Code of the Russian Federation. Please note that if you do not pay, you will have to resolve the issue in court.
Step 4
Analyze the financial performance of the debtor organization. If there are signs of bankruptcy, then file a lawsuit to liquidate the enterprise. It is advisable to do this earlier than the tax office or other creditors of the company. In this case, you will have the right to collect your debt in the first place, and not wait for the obligatory debts to be paid off to employees, the budget and other priority organizations.
Step 5
Submit a lawsuit if the debtor company refuses to return the debt. Attach a copy of the agreement, payment orders, settlement reconciliation statement, claim letter and other available documents to your application.
Step 6
Pay the state fee. Get a court decision on debt collection and a writ of execution, with which you can contact the counterparty directly or through bailiffs.
