If the third party owes money or breaks a contract and causes damage, you have the right to claim compensation. Unfortunately, not everyone is ready to pay their debts. To achieve this goal, act according to a certain plan, this will significantly increase the chances of success.
Instructions
Step 1
Contact the management of the company and talk about the existing debt. Although this step by itself is unlikely to lead to payment of the debt, it will give you an idea of the position of the debtor in relation to the voluntary performance of the obligation, and you can quickly decide on your next steps.
Step 2
If an agreement has been concluded between you and the debtor company, which provides for a pre-trial procedure for resolving a dispute, make a claim. A mandatory claim procedure may be provided not only by an agreement, but also by law for certain types of obligations.
Step 3
When making a claim, justify the amount owed by a detailed calculation. If it is simple and not cumbersome, you can include it in the text of the claim. Otherwise, issue the calculation as a separate document as an attachment.
Step 4
If the law or contract does not set a deadline for responding to a claim, set it yourself. Write that after this period you will have to go to court.
Step 5
Hand the claim in person against the signature of the authorized representative of the debtor company or send it by mail to the legal address by registered mail with notification and a list of attachments.
Step 6
If a negative response is received to the claim, or if there is no response at all from the debtor company, go to court with a claim. To do this, collect all the necessary evidence, draw up a statement of claim, pay the state fee in the amount established by Chapter 25.3 of the Tax Code of the Russian Federation.
Step 7
After receiving a court decision in your favor, work closely with the bailiffs-executors, control how fully they take measures to find the property and funds of the debtor to pay off the debt.
Step 8
If the bailiffs inform you that the debtor does not have funds to cover the amount awarded to you, try to sell the debt to a collection agency - this way you will return at least part of the money owed to you.
