In accordance with Article 263 of the Civil Code of the Russian Federation, the owner of a land plot has the right to erect buildings and structures on it, as well as issue a construction permit to other persons. To build a store on a land plot owned by the company, it is necessary to prepare project documentation and obtain permission from the Department of Architecture and Urban Planning (Article 222 of the Civil Code of the Russian Federation, Urban Planning Code of the Russian Federation).

It is necessary

  • - change the type of permitted use of the delimited land plot;
  • - register a separate ownership right;
  • - obtain a building permit;
  • - to issue documents for individual entrepreneurs or legal entities;
  • - get a license;
  • - obtain permission from the SES;
  • - obtain permission from the administration.

Instructions

Step 1

You can build a store on your own land, but you need to change the type of permitted use of land (Federal Law No. 172-F3). If your land plot belongs to settlement lands and the type of permitted use is individual housing construction, as well as if a residential building has already been built on the site, you need to conduct a land survey, separating the residential building from commercial buildings.

Step 2

Next, contact your local authorities with an application to change the type of permitted use of the land plot that you have set aside for the construction of the store. If you have been issued a decree authorizing a change in the type of permitted use, contact the Federal Office for Unified Land Registry, Cadastre and Cartography to make an entry in the unified register.

Step 3

Contact FUGRTS with a statement. You will be issued a separate title to two delimited land plots.

Step 4

Call in a licensed architect to design and sketch the store and utilities.

Step 5

Contact the Department of Architecture and Urban Planning. Submit your project, sketch, title documents for the land plot. You will be given an act of approval, which you must sign in the administration, in the district communal systems, in the district fire brigade, in the SES.

Step 6

If you have passed all the approvals successfully, you will be given a building permit and a building passport will be issued. The received documents, permitting construction, reserve in the local administration.

Step 7

After the completion of construction, you must put the store building into operation, register ownership in FUGRTS.

Step 8

To start trading, get the documents of an individual entrepreneur or legal entity, a license, permission from the SES and the administration.
