A trademark or brand is sometimes a very valuable intangible asset. Therefore, many companies patent their names at an early stage. This can be done through the patent office.
It is necessary
- - application for registration;
- - a list of goods with your brand, submitted according to the international classification of goods and services.
Instructions
Step 1
The brand is registered only for legal entities or individual entrepreneurs, as it is an element of entrepreneurial activity. He cannot register for individuals. The brand is created directly at the company that is going to register it. You can come up with a brand yourself or contact an advertising agency where other creative minds will create a memorable and tenacious product image (brand).
Step 2
In the first case, you will save on money, in the second, you will get a professionally developed version, taking into account the trends of the modern market and current legislation. But the services of advertising agencies will cost from 300 to several thousand unit units.
Step 3
After you decide on the name and logo, select a list of products that you are going to label. They will need to be indicated in their application to Rospatent, breaking down into goods and services, grouped by classes of the International Classification of Goods and Services (ICGS). It is better to do this with the help of specialists: it is more likely that registration will not be denied.
Step 4
When you intend to patent a brand, be sure to test it for uniqueness. That is, to make a preliminary information search for similar names in a specific type of activity. If the search showed that your brand is "clean", proceed with the application.
Step 5
Here you can act independently or through a patent attorney. Having paid the state fee, submit an application to the Patent Office, in this case Rospatent, and wait for the results of the expert examination. If all goes well, within a month you should receive a "Decision on the acceptance of the application for consideration".
Step 6
Of course, this is not yet evidence of the brand attaching to you, but nevertheless, such a document gives you the right to label your products. It usually takes about 1.5 years to register a brand, but some manage to get it in 5-6 months. The registration of a brand is accelerated by a conventional application abroad for a similar procedure under the Madrid Protocol.
Step 7
After receiving the registration certificate, do not forget to pay the state fee again, otherwise it may be canceled. The certificate is valid for 10 years and can be renewed an infinite number of times.
