Instructions

Step 1

When providing services, performing work, as a rule, an agreement is concluded with the contractor. In some cases, this is not done. Confirmation of the fact of payment for work (services) can be a receipt (cash, commodity), warranty card (if any). Even in the absence of a guarantee, the consumer has the right to return his money within a period not exceeding two years from the date of payment for the work (services).

Step 2

When you find the shortcomings of the work performed, contact the contractor (the company where the services were provided). Write a statement (claim). Address the document to the director of the company whose employees performed the work. Duplicate the claim in duplicate. Attach to the application a check, other documents confirming the fact of payment for the work by you, the provision of services by the contractor.

Step 3

Submit the claim to the contractor. Your copy is marked with the acceptance of the documentation. Put another copy at your place. If the contractor refuses to accept your claim (and this happens), send the documentation by mail to the address of the organization with a receipt acknowledgment.

Step 4

Within 10 days from the date of receipt of the claim by the contractor, the funds must be returned to the consumer. If an examination is necessary, the seller of works (services) is obliged to carry it out in the presence of the buyer. Approximately 45 days are given to check the quality of the work performed. If the contractor refuses to conduct an examination, return money, contact the experts yourself. Come to the company with the results of the check, payment for the examination. The seller is obliged to reimburse the costs of the examination, work, as well as the penalty as soon as possible.

Step 5

When the performer refuses to return the money even after the examination, go to court. Make a statement of claim. Attach all documentation to it, including the claim, the results of the examination. After the trial, by a court decision, the contractor must compensate for the damage. Its size is established by the court.
