Controversial issues regarding the order of registration of goods for sale arise quite often. The fact is that the ownership of such a product remains with the person who leases it, while the entrepreneur sells it on his own behalf on behalf of the owner. Such activity can be called commission trading and should be formalized accordingly.
Instructions
Step 1
Sign a sales commission agreement between the owner of the product and the entrepreneur. This must be done at the time of the actual transfer of the goods for sale. The agreement should specify the percentage of the commission, which is calculated from the amount of proceeds from the sale. The contract is drawn up without fail and must be in writing, this requirement is established by the Civil Code of the Russian Federation.
Step 2
At the time of receipt of the goods for commission, ask the owner for documents that confirm the quality and safety of the product. If the product belongs to a category that requires mandatory certification, then the registration numbers of the certificate, certificate or declaration of conformity must be indicated in the documents for it. This requirement is specified in the provisions of technical regulation and consumer policy of the Russian Federation. If it is not fulfilled, a fine may be imposed on the seller of the goods by tax or other inspection authorities.
Step 3
Accept imported goods that are not subject to mandatory certification only if there is a hygienic conclusion of the sanitary examination. Indicate this item in the contract.
Step 4
Issue a receipt and a product label in duplicate for each unit of goods or for all of the same type of goods. These documents have a unified form and are filled in according to the established rules. When accepting the goods for the commission, one copy remains about the owner of the product, and the second is transferred to the entrepreneur-seller.
Step 5
Issue a settlement document confirming the acceptance of payment for the sale of goods to the end consumer or business entity. This document is not required and is drawn up, as a rule, only at the request of the buyer. Failure to issue it is not subject to penalties.
