The victim, in the presence of an insurance policy, has the right to receive insurance compensation for damage to property or health as a result of a road accident. Step 1
Having become a participant in a road traffic accident, adequately assess the current situation and take measures to collect information about the accident and draw up the necessary documents, so that in the future, a calculation and compensation for damage can be made quickly.
Step 2
Call the agent of the insurance company (if this is included in the service) or, if possible, notify the insurance company about the incident. Try to write down the names and addresses of eyewitnesses to the event and fill out an accident report form. Sketch the road accident diagram for yourself as you see it. Exchange information about insurance policies (series, number) and insurance companies (addresses, contact numbers) with another road accident participant.
Step 3
Check the accuracy, completeness and reliability of the information in the accident certificate (two pages), issued and signed by the inspector of the road patrol service who arrived at the scene of the accident. Please note that the certificate contains all the damage caused, up to scratches, the place and time of the accident. The certificate must be stamped. Take copies of a decision on an administrative offense case or a protocol on an administrative offense and copies of other documents issued by the traffic police inspector.
Step 4
Within 5 days after the accident, at the representative office of the insurance company at the place of residence, fill out an application for payment of damage indicating the circumstances of the accident and the accident plan drawn in it. Attach a certificate of an accident, copies of documents received from the traffic police, a notification of an accident (if completed) and a copy of the vehicle registration certificate, an identity document. On a separate form, indicate the number of the personal account (indicating the bank details) to which the insurance compensation will be paid.
Step 5
Further, the insurer is obliged to inspect the vehicle or organize an independent examination for this. If you disagree with the results of the inspection by the agent of the vehicle insurance company, use the services of an independent examination. When using the results of an independent examination in both cases, do not forget to attach the opinion of an independent examination and documents confirming payment for these services to the application for insurance payment.
Step 6
After submitting an application with attachments, the insurance company draws up an act on the insured event, where the insurance payment is calculated and its size is indicated. Be sure to purchase a copy of the deed. On the basis of the act, the victim is informed of the amount of payments or he is notified of the full or partial refusal to pay. It remains to receive the accrued amount of payments, which cannot exceed the amount of the established insurance amount. Questions regarding disagreement with the accrued insurance company, the amount of damage, are resolved in accordance with the legislation of the Russian Federation. If the costs incurred to compensate for the damage are more than the accrued amount, the remaining part will be reimbursed by the culprit of the road accident. If the guilty party refuses to pay the remainder of the costs, prepare documents for submission to court.
