Instructions
Step 1
Article 313 "On the fulfillment of obligations by a third party" of the Civil Code of the Russian Federation provides for the possibility when one legal entity pays for another. The lender, i.e. the person who receives the money in the end is obliged to accept payment, unless it follows from the terms of the agreement concluded that the debtor must personally pay his debt. More often than not, it is not so important for the recipient who pays for the debtor's organization.
Step 2
Receive a letter from the debtor organization asking you to pay off the debt that is part of its obligations. This document must be of an official nature and appropriate design. The mandatory information that must be indicated in it is the full name and legal address of the debtor and the creditor, the number and date of the agreement concluded between you and the debtor, details for transferring funds, the amount of payment and the number of the agreement under which the payment is made. At the end, the signatures of the chief accountant and the general director of the debtor organization are usually put.
Step 3
Issue a payment order. Indicate in this order the name of the debtor and the number of the agreement under which the payment is being made. Be sure to indicate the number of the letter-agreement that was provided to you by the debtor, since usually a copy of this letter is already available to the creditor by the time the funds are received.
Step 4
Make a copy of the payment order and receipt from the lender, which will confirm the fact of payment. Transfer these copies to the debtor and conclude an act of offsetting with this organization.
