The economic crisis is forcing more and more people to borrow. In practice, life on loan is already becoming an ordinary style of existence. Unfortunately, some of these debtors, living from loan to loan, sometimes "forget" or simply do not pay back their debts. Therefore, if a person came to you and asked for a loan, and you cannot refuse him, insure yourself just in case. Here's how to do it.

It is possible to sue your money - only you need to prepare for this
It is possible to sue your money - only you need to prepare for this

It is necessary

In order to sue your money, if necessary, you will need a loan agreement or IOU, a lawyer and an application to the court

Instructions

Step 1

At the time of transferring money, draw up either a loan agreement or an IOU. In the receipt, indicate in detail your passport data, the passport data of your borrower, the amount of money that you lend to him (it can be indicated both in rubles and the equivalent in currency - do not forget about inflation), the repayment period. In a word, write off as much detailed information as possible about this transaction in the receipt.

Step 2

The repayment period has come, but the debtor does not return the money. Remind him of this, and if he ignores your reminders, go to court.

Step 3

In court, write a statement of claim on the fact of non-repayment of the debt. Such a statement is written in two copies. Describe in detail how everything happened: under what circumstances money was borrowed from you, how much, the repayment period, and so on.

Step 4

Pay the state fee. Remember, this is not a fee for court services, but a regular federal fee for the court to take your case.

Step 5

After payment, take a package of documents, namely: your statement of claim, an IOU and its copy, a receipt for payment of the state duty and submit them to the district court at the place of registration of your unscrupulous debtor.

Step 6

After the court has considered your application and if the decision is in your favor, as well as after the court decision comes into force, you can get your money with the help of the Bailiff Service.
