Living in a "mortgage" apartment, the owner has not yet fully disposed of it. Until the loan is paid off, the housing is pledged by the bank that issued the loan. After the payment of the entire debt, this encumbrance is not removed automatically: the owner of the apartment must re-register the documents himself.

So you've made your final mortgage payment. Now the apartment is completely yours! But this still needs to be properly formalized. That is, to pay off the registration record on the mortgage in the Unified State Register of Real Estate (USRN).

Package of documents

What documents do you need:

  • application for the repayment of the mortgage record. A sample is available on the Rosreestr website (formerly the Regpalata);
  • original loan mortgage agreement with the bank;
  • sale and purchase agreement for an apartment;
  • original mortgage;
  • a certificate from your bank, confirming that you have fulfilled all obligations under the loan;
  • notarized copies of statutory documents of the bank that issued the loan.

General plan of action

In general, the further actions of the homeowner after the payment of the entire amount of the mortgage are as follows:

  1. Submit an application to the bank to remove the encumbrance from the apartment.
  2. The bank makes a note on the mortgage on the apartment that you have paid the mortgage in full. The timing of this stage depends on the specific lending institution.
  3. You receive a mortgage with a mark at the bank and other necessary documents.
  4. Provide a package of documents to the local branch of Rosreestr.
  5. Rosreestr conducts the redemption of the registration record on the mortgage and enters new information into the USRN. This usually happens in three working days.
  6. You will receive an extract from the Unified State Register of Legal Entities confirming the repayment of the mortgage registration record.

Sometimes banks can issue mortgage loans without a mortgage. In this case, the credit institution and the owner of the real estate submit a joint application to the Rosreestr for the repayment of the mortgage record. If you have just such a loan, coordinate all your actions to re-register an apartment with your bank.

If there are several apartment owners (for example, a husband, wife and son), then everyone must submit an application. Or the issue can be dealt with by one person, having received a notarial power of attorney from other co-owners.

Please note that since mid-2016, no certificates of ownership of apartments have been issued in Russia. Now an extract from the USRR is enough, which is printed on a regular A4 sheet of paper.

How to contact Rosreestr

You can submit documents to Rosreestr as follows:

  • personally contact the offices of the Federal Cadastral Chamber (FKP Rosreestr);
  • personally contact the multifunctional center (MFC);
  • via an electronic service on the Rosreestr website.

In the branches of FKP Rosreestr, people often face the need to wait long in queues. If an electronic queue is provided, then the queue for a ticket becomes a problem. Often people come in advance, and then they still have to wait for their time.

It is possible to make an appointment with the Federal State Registration Service of the Federal State Registration Service in advance. To do this, you need to be registered on the "Gosuslugi" portal, and with the same password and login enter your personal account on the Rosreestr website. In the menu, find "Appointment" and select the desired department and available time.

As a rule, it is easier and more convenient to submit and receive documents through the MFC. But on the other hand, it will take a couple of days longer to wait for the finished documents.

Remote application

Now more about how to re-register an apartment remotely. To use this service, you must have an electronic digital signature (EDS). This is an analogue of a conventional handwritten signature, which is used for electronic document management.

You can purchase an electronic signature certificate in a special organization - a certification center. So, a similar center operates under the jurisdiction of the Federal State Registration Service (FKP). Also, special software must be installed on your computer.

If an electronic signature is available, then to submit an application for the removal of encumbrances from an apartment, you can use your personal account on the Rosreestr website. Or, on this site, choose from the menu: "State services" - "Apply for state registration of rights" - "Registration of termination of rights, restrictions (encumbrances) of rights" - "Repayment of the registration record on the mortgage".

Next, carefully fill in all the required fields:

  • Enter your personal information: full name, passport data, SNILS, address, phone number, contact information;
  • Indicate information about the apartment: type of object, cadastral number, address, date and number of state registration of the mortgage;
  • Upload the required documents in electronic format;
  • Verify your actions with an electronic signature.

If everything is in order with the application and documents, an extract from the USRN will be sent to you by e-mail in a few days.
