According to the Family Code, parents are obliged to support children under 18 years of age. In case of divorce, one of them pays alimony in favor of the parent with whom the child was left to support the minor. Alimony can be paid in lump sum or as a percentage of income.

Instructions

Step 1

If you are self-employed and have an unstable income, then the most acceptable option for paying support for your child is to designate a solid amount of money. You can draw up a written or notarized agreement to pay child support. If you have drawn up a written document, have it certified by a notary.

Step 2

You can specify any amount in the agreement, but not lower than the percentage based on the minimum wage. This means, if you have drawn up an agreement on the payment of alimony for one child, then the minimum amount should be 25% of the minimum wage, for two children - 33%, for three or more - 50%. But this can only be done if this option suits both parties. If one party does not agree to a voluntary agreement or believes that the indicated amount is too small, go to court.

Step 3

The court will decide how much you will pay to support the child or children. If the parent with whom the child lives believes that the amounts paid may be significantly higher, then this is also decided in court. A commission will be appointed to determine your income, namely, from all income you are required to pay alimony. This is especially true if you are engaged in entrepreneurial activity and pay a single tax without indicating the total amount of income in the submitted declaration.

Step 4

Therefore, if you have a sufficiently large income, then it is better to immediately draw up an agreement on the payment of a sufficient amount of alimony without resorting to court proceedings.

Step 5

If you registered as an individual entrepreneur, and you have no income, then it does not matter at all, you are obliged to pay alimony for maintenance, regardless of financial situation and other circumstances.

Step 6

If you have been ordered to pay child support as a percentage of gross income, but you think the amount paid is too high, go to court. The paid maintenance can not only be increased, but also decreased, if such a decision is made by the court.
