Sberbank has the right to write off money from a debit card, but only if a number of conditions are met. Such a possibility must be specified in the contract. The entire amount cannot be withdrawn from the salary card.
If you have a large debt on a loan or other obligatory payments, you may be faced with the fact that funds will be withdrawn from the card. Sberbank can withdraw all money from a debit card only in one case. However, such a decision is usually made when the case is being considered in court, when it is transferred to the bailiffs.
Can money always be withdrawn from a Sberbank debit card?
Art. 101 of the Federal Law "On Enforcement Proceedings" says that there are types of income on which collection cannot be levied. These include funds:
- paid as compensation for harm caused to health;
- transferred in connection with the death of the breadwinner;
- transferred to persons who were injured, injured during the performance of official duties, to members of persons in the event of the death of such citizens.
Compensation payments to victims of radiation and man-made disasters, as well as those received in connection with caring for disabled citizens, cannot be withdrawn. Maternity capital funds, amounts paid in the form of alimony are not used to pay the debt.
Can money be withdrawn from a salary card?
If a person is subject to enforcement proceedings, the procedure for debiting money has been launched by bailiffs, then you can withdraw money from the card. The amount cannot be more than 50% of the salary. However, this point is often violated. The work of the bailiffs does not include checking the nature of the account. Therefore, they may not know that this card is a salary card.
In such a situation, it is necessary to apply with a written statement to the bailiff. It should justify the need to remove the arrest from the salary account. If such actions did not lead to a result, you can go to court or to the immediate supervisor of the bailiff.
Can Sberbank directly withdraw money?
This possibility is allowed only in one situation, if there is a clause in the loan agreement that, in the event of a loan debt, the bank itself can write off money from other accounts. In such a situation, it is necessary to draw up and send an appeal to the bank. The answer must contain the reasons on the basis of which the money is debited. If this is done by the bank, you can ask the employer to transfer the salary to the card of another financial institution.
