Chief (authorized or senior) at the entrance - the position of one of the tenants, appointed during the general meeting and providing for the maintenance of order at the entrance, as well as some other duties. Often, the elders at the entrance collect funds from residents for various needs, and it is important to make sure in advance of the legality of these actions.
General duties of the main entrance
The head of the house or entrance is appointed during the next meeting of tenants by voting for the nominated candidates. If it was not possible to select a suitable applicant at the meeting, the management company or housing cooperative has the right to select and appoint him. The duties of the main entrance (house) are as follows:
- control over the cleanliness and quality of cleaning of all public facilities in the entrance (house), as well as the adjacent territory;
- control over organizations operating the housing stock, on the implementation of their contractual obligations (landscaping, cleaning, etc.);
- control over compliance with standards of hygiene, ecology, sanitation and fire safety;
- elimination of violations in the use and maintenance of common property;
- proposal and implementation of ideas for improving and preserving common house property;
- explaining to tenants their legal status regarding the maintenance and operation of residential and other premises;
- familiarization of residents with the contacts of operating operating organizations;
- control of current or major repairs;
- interaction with fire authorities, law enforcement, social protection and health services serving the residents of the entrance (house).
In addition, the entrance supervisor is obliged to keep sets of keys for emergency exits and technical rooms, as well as magazines with minutes of public meetings and other documents related to the housing stock. At the end of the year, this person is obliged to report on the work done at the general meeting of residents.
Financial obligations and rights of the main entrance
With the legal appointment of the main entrance by the management company, a work contract is concluded with the organization, which may provide for a certain procedure for remuneration of this authorized person. In this case (with the consent of the owners) the funds will be divided among the residents of the house and included in the monthly utility bill.
If the head of the entrance is appointed unofficially at the general meeting of residents, the remuneration of the official can be made in other ways, for example, by monthly door-to-door rounds. One way or another, the settlement procedure should be negotiated in an agreement with the owners.
Given that the headman on the entrance has a duty to suggest and implement ideas in order to improve the common property and territory, he has the right to collect money from residents for the implementation of the plans. However, for the legality of these actions, all ideas must first be made public, that is, they must be brought to the owners at the next meeting. The latter are obliged to vote for the expediency of the proposed solutions.
In case of approval of the actions of the head of the entrance, a protocol is drawn up on the improvement of general house needs, copies of which are sent to each of the owners of residential premises for signature. The minutes indicate the amount of funds collected from each tenant, as well as the total amount required to implement the plans. Only in this case, the head of the house receives the right to further house-to-house visits in order to collect appropriate funds. If this person demands or even forces to issue funds without explaining the reasons, such an illegal act can be classified under the article on extortion, and it must be reported by contacting the law enforcement agencies. If the levies have already been made, all funds must be reimbursed to the tenants.
In case of an urgent need to collect money, for example, to eliminate an emergency at the entrance, the authorized person is obliged to provide documents proving the expediency of these actions. For example, this can be the opinion of the management company, fire authorities or law enforcement agencies. After the implementation of the planned actions, the senior at the entrance is obliged to report on the work done at the next meeting of neighbors.
