Step 1
In order for you to have this very chance of getting the money back, at the moment when you transfer your funds to the borrower, draw up a document. It can be either a loan agreement or an IOU, which is also considered this document.
In the IOU, be sure to indicate the passport details of the borrower, your own passport details, the amount of the loan in rubles, or in the currency in which you are borrowed.
Step 2
So, the deadline for repayment has approached, and your debtor begins to evade. Remind him of duty, if he does not respond, go to court.
In court, you will need to write a so-called statement of claim (in duplicate). Again, do not save words - describe in great detail the whole situation: how, when and under what circumstances this citizen borrowed money from you.
Step 3
Then, in order for the court to accept your application for work, and it was considered, you will need to pay a state fee. Remember that paying the fee does not guarantee you will win in court. Firstly, the fee is just a federal fee, and secondly, it is not payment for court services.
Step 4
After that, take several documents, namely: your application, a receipt for payment of the state fee, an IOU, a copy of it, and submit these documents to the district court at the place of residence of your debtor. The process has started.
Step 5
The court will consider your case, make a decision, and when this decision comes into legal force, you can enforce it with the help of the Bailiff Service.
