Instructions
Step 1
Determine the refinancing rate.
The refinancing rate is an indicator that is taken into account without fail when calculating penalties for non-payment of taxes or when calculating compensation for an employee in case of delayed wages.
The refinancing rate is set by the Central Bank on the basis of the relevant meetings and by issuing a Resolution. The result of accepting a bet is a decree, which serves as a guideline when calculating this parameter.
As a rule, the Central Bank changes the rate of interest every two years. Today it is generally accepted that the refinancing rate is 8%, which is confirmed by the Directive of the Central Bank of the Russian Federation dated February 25 of this year. Compared to the previous year, the rate increased by 0.25%.
Step 2
Calculate 1/300 of the refinancing rate.
It is worth clarifying that when calculating penalties, not the entire refinancing rate is used, but only its three hundredth part. This parameter is established by law in accordance with Article 75 of the Tax Code of the Russian Federation.
When calculating compensation to an employee in case of delayed wages, one three hundredth of the refinancing rate is also used. This is spelled out in law and regulated by Article 236 of the Labor Code of the Russian Federation.
Step 3
Calculate indicators
Calculations are made according to a formula developed specifically for the relevant tax authorities and for the company's accountants. It is customary to use it without fail when calculating the indicated indicators. Formulas are approved by law and cannot be edited.
P = C * P * 1/300 * K, where
P - penalty interest, S - amount of unpaid tax, P - refinancing rate, K - number of days of delay.
КР = С * Р * 1/300 * К, where
KR is the employee's compensation, P is the refinancing rate, K is the number of days of delay in wages, starting from the day of wages established by the employment contract and ending with the day of its actual payment.
