Step 1

In accordance with the law of the Civil Code of the Russian Federation, certain normative acts are adopted for organizing auctions, which do not contradict the general rules of the Code of the Russian Federation. Thus, the subjects of bargaining can be different types of property, work and services.

Step 2

The form of the auction is determined by the owner of the thing being sold or the owner of the property right (for certain types of property, only one form of auction can be provided - an auction or a competition). The organizer of the auction can be any owner of the thing, the owner of the property or a specialized organization.

At least thirty days in advance, the organizer of the auction is obliged to make a notice of their holding, indicating the necessary information (place, time, form of the auction, rules for holding, the subject of sale, certain data that must be included in the application for participation in the auction) …

Step 4

To participate in the auction, an interested person should submit an application to the organizer for participation in the auction and other documents (for example, an extract from the unified register of legal entities should be provided). Also, in order to participate in the auction, the participant must make a deposit in advance, which was established by the organizer in a certain amount, time and order. If for some reason the auction does not take place, the deposit will be returned to its owner.

Step 5

The organizer of open tenders may refuse to conduct them at any time for him (no later than 3 days before the start of the auction) in the form of an auction or no later than 30 days before the start of their conduct in the form of a tender. The organizer of a closed auction (auction or competition), which refused to conduct them, must compensate the invited and bidders for certain damage (regardless of the refusal period). It is not stated otherwise in the law or in the notice regarding closed trading.

Step 6

The person who sent the application and the necessary documents to participate in the auction may be refused in such cases as:

- if he has violated the deadline for filing an application;

- if an application for participation in the auction is submitted from a person who, in accordance with the law, does not have the right to acquire the property that is put up for auction;

- if the person for participation in the auction has not provided all the necessary documents (their list may be established separately by law or in the notice of the auction).
