You can get a loan not only from a bank, but also borrow money from individuals. In order to avoid further problems and misunderstandings, it is necessary to correctly issue a loan by drawing up a notary agreement or a written receipt.
It is necessary
- - a handwritten or notarized contract;
- - passport.
Instructions
Step 1
If you borrow money from individuals, be sure to draw up documentary evidence in accordance with all the rules provided for by current legislation. Regardless of whether you conclude an agreement in a notarized or simple written form, it will have the same legal force and must be strictly enforced.
Step 2
When you contact a notary, you will draw up a loan agreement in accordance with all the rules, taking into account all the points that need to be included, so there is no special need to delve into its design.
Step 3
Use an A-4 sheet of paper and a ballpoint or fountain pen to write your loan agreement by hand. Do not use printing devices. The contract must be drawn up in duplicate and written by hand.
Step 4
Indicate who, when, where, how much, for how long, at what interest the amount was issued and received. Provide full details of the borrower and lender, as well as two witnesses from the lender and borrower.
Step 5
Write the received loan amount in words and figures. After the indicated amount, put a Z so that nothing can be signed. Do not make mistakes in writing the contract and corrections. At the bottom, put the date and signatures of all those present.
Step 6
Receive and transfer funds only in front of witnesses. Give the second copy of the lender's agreement from hand to hand only after receiving the entire loan amount. You give the contract, you are given a loan.
Step 7
Return borrowed funds only in the presence of witnesses. Receive a receipt from the lender that the entire amount issued has been received in full and all interest on the loan issued has been paid. This will save you from many troubles associated with the resulting misunderstandings.
Step 8
Do not forget that both parties are obliged to comply with the terms of the contract. If you have any disputable questions, please apply to the arbitration court.
