In the course of their activities, enterprises are faced with a situation when counterparties or buyers refuse for any reason to pay for the goods supplied or services rendered. As a result, accounts receivable are formed that underestimate the amount of free working capital of the company. You can collect it by going to court, but first it is recommended to draw up and send a letter to the debtor about the receivable.
Instructions
Step 1
Draw up a claim letter for accounts receivable according to certain accepted rules. They are not fixed and established anywhere, but at the same time they are requirements of business etiquette and business interests. Use a strict, concise and business-like writing style when compiling. Emotional phrases should not be used.
Step 2
State the point in a polite and respectful manner. This is due to the fact that the debt to you from the enterprise could arise as a result of temporary difficulties, which will soon be resolved, and you will again continue a successful cooperation. Thus, you should not rashly spoil your relationship with business partners. The letter must be written on the official letterhead of the company. On the top left, the surname, name, patronymic in the genitive case of the head and the name of the debtor enterprise are indicated.
Step 3
Indicate in the letter all your requirements, namely: the amount to be repaid, and the timing of its repayment. Note the exact consequences awaiting the debtor if he continues to shirk his responsibilities. These points can be stipulated in the contract that your companies have entered into. Calculate the fine, interest and other points that the debtor is obliged to pay.
Step 4
Refer to the provisions of the Civil Code of the Russian Federation, which are associated with violations of payment and accrual of interest for the use of other people's funds. For example, you can indicate Article 190, Article 192 and Article 614 of the Civil Code of the Russian Federation, if the receivable was formed for rent.
Step 5
Attach to the letter the calculation of accounts receivable for the delivered goods or services rendered. Certify both documents with the signature of the head and the seal of the organization. Be sure to put the outgoing number and date of compilation on the letter. One copy of the claim remains for storage in the outgoing correspondence of the enterprise, and the second must be sent by registered mail with a list of investments by the debtor organization.
