Monetary compensation for unused vacation days is paid to the employee in case of dismissal and if it is impossible to go on another vacation. This compensation is unconditionally guaranteed by labor legislation and does not depend on the grounds for dismissal. The calculation of compensation is made in the manner specified in Art. 139 of the Labor Code.

Step 1

Determine for how many days the monetary compensation is due. For a fully worked year, 28 calendar days of vacation are provided. If the working year is not fully completed, the number of days is determined in proportion to the months worked. If less than two weeks have been worked in a calendar month, the days are excluded from the calculation, if 15 days or more, the number of months is rounded up to a full month. For example, an employee is entitled to compensation for unused vacation for the period from 01.01.2010 to 18.04.2010. The number of days of unused vacation in this case is 28 days / 12 months. x 4 months = 9, 33days

Step 2

Determine the size of the average daily earnings. For such a calculation, it is necessary to divide the actually accrued amount of the employee's wages for the previous 12 calendar months by 12 and by a factor of 29.4 (average monthly number of days).

Step 3

Calculate the amount of compensation. Multiply the calculated number of days of unused vacation by the average daily earnings.
