People from Belarus and other countries who are officially employed in the Russian Federation can apply for SNILS for the opportunity to receive a state pension in the future. Registration can be carried out personally by a citizen or his employer.
Registration of SNILS through the employer
The procedure for registration and receipt of SNILS by foreign citizens is set out in Federal Law No. 167 "On Compulsory Pension Insurance in the Russian Federation". In accordance with it, in order to participate in the compulsory pension insurance system, immigrants from Belarus and other countries must comply with certain conditions. First of all, a citizen should not be a highly qualified specialist, according to Federal Law No. 115 “On the Legal Status of Foreign Citizens in the Russian Federation”. He is also obliged to pre-conclude an employment contract for any period.
After concluding an employment contract, a foreign citizen is obliged to notify the employer of his desire to participate in the pension program of the Russian Federation. After that, the employer must submit to the Pension Fund the employee's questionnaire in form No. ADV-1, filled in by the applicant for a pension and confirmed by his signature.
If the applicant does not speak Russian, he has the right to fill out the questionnaire in his native language, transferring the necessary data from the identity document into it. However, in this case, the application must first be submitted to a notary company, where a notarized translation of the questionnaire into Russian will be made.
In addition, the employer is required to submit documents in the ADV-6-1 form to the Pension Fund within two weeks from the date of employment. Within three weeks from the date of transfer of documents, the PF prepares a pension certificate with a unique SNILS number assigned to it for a foreign citizen.
Self-registration of SNILS by a foreign citizen
Representatives of the near or far abroad, employed in accordance with Russian law, have the right to independently apply to the Pension Fund for registration of SNILS. It is enough to choose the local branch of the PF RF and apply to it with an identity document, as well as a work book with a note of employment in Russia.
If the applicant's personal documents are drawn up in a foreign language, it is necessary to notarize their copy translated into Russian. SNILS will be produced and issued within the next two weeks after the transfer of documents. It is important to note that neither the employer nor the Pension Fund have the right to refuse a foreign citizen to receive pension accruals. This is enshrined in Federal Law No. 173 "On Labor Pensions in the Russian Federation" and provides for the same procedure for calculating and receiving payments for representatives of foreign countries as for Russian residents.
