Women who take parental leave are entitled to a monthly allowance. To do this, the employee needs to write an application addressed to the employer. The amount of the allowance depends on the employee's average earnings over the previous two years. Moreover, it should not be lower than the minimum wage.

It is necessary

  • - settlement statements for 24 months;
  • - statement of the employee;
  • - production calendar;
  • - federal legislation;
  • - acts of the local government on the size of the minimum wage;
  • - calculator.

Instructions

Step 1

After the birth of a child, a woman is entitled to a lump sum payment, which is charged to the employer. The latter issues it to the employee according to the payroll. The enterprise is obliged to pay an employee who has gone on parental leave 40% of her average earnings. A monthly allowance is calculated on the basis of a statement in which the employee makes a request to appoint such a payment.

Step 2

Determine the woman's average earnings. The period for its calculation will be 24 calendar months. For workers who have taken parental leave before 31.12.2012, there is a choice. An employee can be calculated a monthly allowance according to the legislation in force before 01.01.2011, or in accordance with Federal Law No. 343. From 01.01.2013, women will not have such a right.

Step 3

According to the law that was in force before 01.01.2011, the amount of the benefit is calculated by including in the average earnings the periods of the woman's actual work, periods of disability, parental leave and other cases. According to Federal Law No. 343 of the President of the Russian Federation, when calculating average earnings, only the periods of performing a labor function at a particular enterprise will be included, that is, a woman received a salary. All social payments are excluded from the calculation.

Step 4

Add up the employee's salary for the period of calculating the average earnings, bonuses, travel and other payments that are of a permanent nature. Divide the received amount by the number of calendar days in two years. Typically, this is 730 days. The result will be the employee's average daily wage.

Step 5

Multiply the worker's average daily earnings by the average number of calendar days in a month. Take 30.4 for the last value.

Step 6

Multiply the average monthly earnings by forty percent. Transfer the received amount to the woman's account every month until her child reaches one and a half years.

Step 7

Please note that the average earnings should not be less than the minimum wage. If the result is less than the minimum wage, charge 40% of the established value.
