Even if you named your store "Pobeda", trouble can come unexpectedly. When your competitor opens a store with a similar name and registers it as a trademark. In this case, you will have to urgently change not only the name, but it is likely that you will also have to explain with a competitor about the use of his property. After all, any trademark is property. How do you register a store name in order to save yourself from possible consequences for your business and property?
Instructions
Step 1
If you registered an individual entrepreneur, then on the sign of your store you must indicate not only its name, but also the EGRIP and TIN. In addition, you will have to indicate the name of your store (for example, IE Soloviev Shop "Cheburashka" EGRIP … INN …) when registering an IP and registering a cash register. Of course, as an individual entrepreneur, you may not register your trademark with FIPS (Rospatent), but it is better to do this in order to subsequently avoid possible legal proceedings with its real owner.
Step 2
Please note that the name of the store, in the event that you decide to register a legal entity, must be registered as a trademark, even if your LLC has a different name.
Step 3
Read the Law of the Russian Federation "On Trademarks". Choose a name for your store so that FIPS will not refuse you to register it as a trademark.
Step 4
Contact FIPS with an application for the registration of your trademark. Attach the following documents to your application:
- image of your trademark on paper and in electronic form in established formats;
- certificate of registration of IP / LLC (certified copy);
- statistics codes (certified copy)
- a receipt for payment of the state duty.
Step 5
Prepare for the fact that consideration of your application for registration and grant of a patent may take up to 1.5 years. During this time, the following procedures will be carried out:
- the procedure of formal examination (identification of the compliance of all submitted documents with reality and the correctness of their preparation) - up to 1, 5 months;
- examination of the claimed designation (identifying the identity and similarity of a trademark with previously declared or registered ones and checking for the absence of certain grounds specified in the Law "On Trademarks" that may prevent its registration) - the period is not limited.
Step 6
Get a trademark certificate. The period of validity of the exclusive right to a trademark is 10 years, but it can be extended in the future an unlimited number of times.
