When the term of a deposit or deposit comes to an end, depositors express a desire to withdraw their funds and refuse the services of the bank. Despite the fact that banks do not have the right to refuse to issue deposits and funds from current accounts, depositors may encounter certain difficulties in this matter.
Instructions
Step 1
Currently, all banks with temporary administration have moratoriums. Experts argue that this prohibition does not apply to all depositors, but only to persons who have issued a loan to a financial institution. If the bank refuses or delays the issuance of a deposit, you should go to court to protect your rights.
Step 2
First, you need to submit an application addressed to the head of the bank branch for the return of the deposit. It is better to write such statements in two copies: one for the bank, the second must be kept for yourself. An employee of a bank branch must sign the documents, confirming the acceptance of the application, as well as indicate the date and stamp.
Step 3
When sending an application by registered mail, keep the notice of receipt of the letter by the bank. In the future, it will replace the seal of the financial institution on the document in court proceedings.
Step 4
To submit to the court, you will also need to provide: bank deposit agreement; receipts confirming the deposit of money to the specified deposit account; your application for a refund; confirmation of receipt by the bank of this letter; the bank's response to your letter on the return of the deposit.
Step 5
Write a statement of claim to the court. Having achieved a positive result for you, you will receive not only an official court decision on this dispute, but also a writ of execution. Contact the executive service with these documents. Further, the state executor will seek the payment of your contribution. This procedure will take about six months or more.
Step 6
There is another way to get money back from a bank deposit - offsetting a deposit and a loan. If the depositor has a loan in the bank, and also has a deposit, he can write an application to the credit committee with a request to set off these funds to repay the loan. But in this case, the depositor will return only part of the deposit funds.
