With the entry into force of the current edition of the Housing Code of the Russian Federation, the separation of personal accounts has ceased. The current version of this regulation does not provide for such a possibility. However, if the apartment belongs to several owners, you can divide their obligations to pay for utilities by a written agreement or a court decision.
It is necessary
- - passports of the owners;
- - documents on the ownership of housing;
- - agreement on the procedure for payment of utilities;
- - a statement of claim to the court, if the owners cannot agree;
- - money to pay for notary services or state fees when filing a claim.
Instructions
Step 1
In normal relations between the owners, it may be enough to verbally agree on who should pay how much. But oral agreements have one drawback - they cannot be filed to the case, and if necessary, it will be problematic to prove their existence. If all owners will regularly fulfill their obligations, such a need, of course, will not arise. But this cannot be guaranteed 100% in any, even the most ideal, situation. Therefore, it is still better to secure the agreements on paper, which, if something happens, can be presented to housing and communal services workers or the court, thereby protecting yourself from unfair accusations.
Step 2
You can draw up an agreement or agreement on the procedure for paying for utilities yourself or ask for help from a lawyer or notary. Notarization of the document is not necessary, according to the law, a simple written form is sufficient, but an agreement with a notary's visa always looks more convincing. When concluding an agreement with a notary, he must see the passports of all owners, documents on the right to property, an extract from the house book and a copy of the financial personal account (the last two documents are taken from the house management).
Step 3
If it is not possible to agree in any way, it remains to apply to the court with a statement of claim containing a request to determine the procedure for payment of utilities by the owners. It will need to attach the same documents that a notary should see, plus receipts for payment of state fees. Additional documents may be required (for example, confirmation of the tenant's belonging to the family of one or another owner) to prove the arguments and facts presented in the claim.
