What to do if Sberbank blocked an account

Blocking bank accounts causes a lot of trouble for customers. This usually happens unexpectedly. There can be many reasons for blocking: a court decision that has entered into force, the appearance of suspicions about the legality of the client's banking operations. After the Federal Law No. 115 "On Counteracting the Legalization (Laundering) of Criminally Obtained Incomes and the Financing of Terrorism" was issued, representatives of Sberbank and other credit organizations began to restrict the ability to perform certain transactions on their clients' accounts more often. But it must be remembered that complete blocking is not entirely legal. The card can be blocked only by a court decision after the enforcement proceedings come into force. Accounts can be seized by employees of the Federal Financial Monitoring Service, but only for a period not exceeding a month.

If a client finds a blockage, he needs to contact the Sberbank branch in which he is served. It is impossible to do this by calling the hotline, since the personal presence of the person who has concluded an agreement with the bank is required.

The client may consider the seizure of accounts unlawful if he was not provided with the documents on the basis of which this action was performed.   • indicate the circumstances under which the client discovered that his accounts were blocked.

When making a claim, it is imperative to refer to the current legislation. In your application, it is worth pointing out violations of the following legal norms:

  • Article No. 858 of the Civil Code of the Russian Federation (limitation of the client's rights to dispose of the funds that are on his account is not allowed, except for the imposition of seizure on the funds in the account, or suspension of transactions on the account in cases provided for by law);
  • article No. 845 of the Civil Code of the Russian Federation (the client can freely dispose of the funds available in his bank account);
  • Federal Law No. 115 (in accordance with this legal act, the bank may refuse the client to perform suspicious monetary transactions, demanding to provide documents for clarification, but not block the accounts).

In a claim to Sberbank, it is imperative to indicate whether employees have requested any documents to confirm transactions. If this was not done, the employees of the organization classified all transactions carried out on the client's accounts as questionable. Such actions are a gross violation of the law.

At the end of the claim, you must definitely formulate your requirements:

  • consider the application within the time limits established by law;
  • check the legality of the actions of the bank's employees and take action in case of violations;
  • unblock accounts within 3 days from the date of receipt of the request.

A copy of the agreement with the bank and a copy of the passport must be attached to the claim. If the client has not received an answer to his request and the accounts have not been unblocked, he can contact the Ombudsman Service, which is an independent division of Sberbank and deals with complex issues and disputes. A complaint can be made to the Central Bank. When it is not possible to unblock the account, the client can apply to the prosecutor's office or court.
